Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: employees were exposed to being crushed while operating a powered industrial truck which had a rollover/falling-object protective structure (ROP/FOP), but which did not have seatbelts (i.e., the seat was not fitted with seatbelts). (a)Allen Beverages, Inc. d/b/a Pepsi Cola Bottling Company of Gulfport, 13300 Dedeaux Road, Gulfport, MS. - On or about November 4, 2009, employees operating the 2004 Model Nissan Optimum 50 powered industrial truck, Company #9, were exposed to being crushed by the rollover/falling-object protective structure (ROP/FOP) due to the absence of seatbelts. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide, require and enforce the use of seatbelts.
