Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees operating powered industrial trucks equipped with rollover protective (ROP), or falling-object protective (FOP), structures were exposed to crushing hazards due to not wearing their seatbelts: (a)Coca-Cola Bottling Co. Consolidated Warehouse, 7900 Highway 57, Ocean Springs, MS 39565 - On or about November 5, 2009, two (2) separate employees operating separate forklifts were not wearing their seatbelts while loading pallets of soft drinks into/onto route truck(s) in the warehouse. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require and enforce the use of seatbelt usage for operators of powered industrial trucks.
