Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee who was operating a powered industrial truck was not wearing the seat belt because the belt fastening mechanism was broken. (a)New Albany, MS facility - On or about March 5, 2010, an employee was observed operating the old red Nissan 30 LPG-fueled powered industrial truck while not wearing the seat-belt because the belt's fastening mechanism was broken. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a replacement seat-belt with a properly functioning fastening mechanism.
