Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by vehicular traffic. (a) Poorhouse Road East of South Montgomery Street - On or about March 23, 2010 employees were exposed to being struck by moving vehicles while working along the road without wearing high-visibility reflective vests. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the final rule on Worker Visibility of the Federal Highway Administration (FHWA) Section 634.3 which requires use of high visibility apparel, such as, vests that meet ANSI/ISEA 107-2004 Standard for High Visibility Safety Apparel.
