Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed the hazard of being struck by falling load, in that, the employer did not ensure that the safety latch on the hook was operable. (a) Mississippi Veterans Memorial Cemetery, Newton, MS - On or about June 10, 2010 the latch on the load hook used to lift 15 inch pipes weighing up to 2000 pounds was rigged to remain open. The latch on the hook was inoperative, therefore the hook did not comply with ASME/ANSI B30.10 - 1993 standard for hooks, section 10-1.3.
