Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazard of heat stress, heat exhaustion and heat stroke. (a)Highway 613, Main Street, Moss Point, MS - On or about August 2, 2010 the employer did not protect employees from the recognize hazard of heat stress, heat exhaustion and heat stroke while employees were installing formwork for curbs with temperatures exceeding 97 degrees fahrenheit at 11:30 am and with a humidity of 74%. There was no wind and the heat stress index reached 130 degrees fahrenheit. A new employee was not properly acclimated to the extreme heat condition. Among other methods, one feasible and acceptable method to correct this hazard employees and provide employees additional training on heat stress.
