Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: Struck-by hazard due to the employer not ensuring his
vehicle was maintained
in a safe condition.  The clutch pedal surface was smooth metal and
provided minimum friction
between the operator's foot and the clutch pedal surface.  The clutch
pedal did not have a clutch
pedal pad. The possibility of the operator's foot slipping off the clutch
pedal is significantly
increased when the clutch pedal does not have a pad or other friction
surface.
(a)Garrett Furniture, 911 Hwy 82 W., Indianola, MS - On or about August
28, 2010
a roll-off dumpster truck with a standard shift transmission did not have
a clutch pedal
pad to provide a friction surface between the clutch pedal and the
operator's
foot. The
roll-off dumpster truck operator was backing the truck to a dumpster for
loading when
his foot slipped off the clutch; which caused the truck to lurch backwards
and pin an
employee between the dumpster and truck.
