Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were allowed to operate mobile equipment without wearing seat- belts. (a)Loading Dock area, East of plant's Northeast corner, and throughout the LPG- Tank Storage Yard - On or about Saturday, October 9, 2010, employee(s) were allowed to operate rough-terrain forklifts (telehandlers), i.e. Lull Model 6K-37, Company #2, transporting heavy loads, while not wearing the provided seat belts. Among other methods, one feasible and acceptable abatement method to correct this hazard is to implement a well-communicated, and well-enforced requirement that all operators of rough terrain forklift trucks, equipped with operator restraint systems, must wear the seat belts, as required by Paragraph 6.2.1(a) of American Society of Mechanical Engineers (ASME) B56.6- 2005 (with addenda) Safety Standard for Rough Terrain Forklift Trucks.

Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that chain hoists, and their supporting structures, were not being thoroughly inspected on a frequent and a periodic basis. (a)Leg & Lug Welding Area (Spot X-Ray) - On or about October 20, 2010, employees were exposed to injury from falling loads due to the employer's failure to initiate a program to have competent persons thoroughly inspect all two-ton overhead chain hoists, air or electric powered, along with their supporting structures, for worn and/or damaged parts: in that the Ingersoll-Rand ARO air-operated two-ton overhead chain hoist, at the Leg & Lug Welding Area (Spot X-Ray), being used to lift LPG (liquified petroleum gas) tanks and/or components weighing as much as 1800 pounds was being supported beneath its trolley by a badly worn horizontal pin. The employer did not have an inspection program for chain hoists as required by Sections 16-2.1.2 and 16- 2.1.3 of American National Standards Institute (ANSI) B30.16-2007, Safety Standard for Overhead Hoists. Among other methods, one feasible and acceptable abatement method to correct this hazard is to initiate a program of frequent and periodic inspections of all chain hoists, air and electric, and their supporting structures, as required by Sections 16-2.1.2 and 16-2.1.3 of American National Standards Institute (ANSI) B30.16-2007, Safety Standard for Overhead Hoists, and to replace any and all worn or damaged components before returning the hoists to service.
