Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from vehicular traffic. (a) Interstate 59 South of the US 49 Intersection - On or about October 18, 2010 an employee was exposed to struck-by hazards while working on the highway right-of-way when he was not wearing a high-visibility vest or clothing. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the final rule on worker visibility of the Federal Highway Administration (FHWA), 23 CFR Part 634, Section 634.3 which requires use of high visibility apparel, such as vests that meet ANSI/ISEA 107-2004 Standard for High Visibility Safety Apparel.
