Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards due to the absence of headlights on a red Mack dumptruck, a white Mack dumptruck and a front loader with a cracked windshield. (a) Limestone Yard - On or about October 27, 2010 employees were exposed to struck- by hazards while working near a red dumptruck and white dumptruck without functioning headlights. Among others, one feasible and useful abatement method to correct these hazards is to equip the dumptrucks with headlamps. (b) Limestone Yard - On or about October 27, 2010 employees were exposed to (b) Limestone Yard - On or about October 27, 2010 employees were exposed to struck- by hazards when working near a Caterpillar front loader with a cracked windshield. Among others, one feasible and useful abatement method to correct this hazard is to replace the windshield.
