Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing, or likely to cause, death or serious physical harm to
employees in that employees
were exposed to fall hazards and electrical hazards:
On October 1, 2009, and at times prior thereto, employees utilized and
operated
a vehicle-mounted aerial lift with the deficiencies listed below. The
employees
were exposed to fall hazards and electrical hazards:
a.The flooring of the personnel basket was cut out in a large U-shaped
pattern large enough for employees to fall through.
b.The personnel basket was a shop-made basket which had not been
approved by the manufacturer of the aerial lift device.
c.The electrical wiring and connections did not have their protective
coverings; terminations were exposed to environmental damage.
d.Pulleys and belts on the aerial lift did not have their protective guard.
e.The wire rope/cable of the aerial lift was worn and frayed; there were
numerous broken strands of wire rope.
f.Electrical wiring from under the interior dashboard of the Ford F-350
truck was permitted to dangle.
Among other methods, one feasible and acceptable abatement method to
correct
these hazards is to perform maintenance and conduct and record inspections
and
tests on the vehicle-mounted aerial lift as recommended by the manufacturer
and/or at least annually in accordance with the American National Standards
Institute(ANSI) American National Standard for Vehicle-Mounted Elevating
and
Rotating Aerial Devices, as stipulated below:
1.Section 8 Responsibilities for the Owners and Users 8.2 Inspection and
Testing Classifications 8.2.2 Regular inspections and Tests.
2.Items determined by the user based on manufacturer for each specific
aerial device shall be inspected for defects. Inspection and tests referred
to as critical in the manufacturers's manual shall be strictly adhered to.
3.Ensuring the following tests and inspections are performed by the
operator
once daily, prior to first use:
A.Operating controls and associated mechanisms for conditions
interfering with proper operation
B.Visual and audible safety devices for malfunction
C.Hydraulic or pneumatic systems for observable deterioration or
excessive leakage
D.Fiberglass and other insulating components for visible damage or
contamination
E.Missing or illegible operational markings
F.Electrical apparatus for malfunction, signs of excessive
deterioration, dirt, and moisture accumulation.
4.Any suspected items shall be carefully examined and determination made
by a qualified person as to whether they constitute a safety hazard. All
unsafe items shall be replaced or repaired before use.
