Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to injuries that could occur as the result of operating a box
truck with a potentially
defective "U" bolts to deliver meals and supplies at the South Eastern
Missouri State
University(SEMO) campus dinning halls as well as locations within 30 miles
off campus.
On or about 08/27/2009, the employer did not ensure that the U bolts that
secure the
trailer box to the chassis of GMC W4500 truck were tightened periodically
as
recommended by the manufacturer of the trailer box. The employees were
exposed to
injuries that may occur during vehicular accidents,while operating the
truck to deliver
meals and other supplies to campus dining halls at the South Eastern
Missouri
State
University(SEMO) as well as within 30 miles off the university.
WHILE ULTIMATE RESPONSIBILITY FOR CORRECTING THE HAZARDS RESTS
WITH THE EMPLOYER, GIVEN HIS/HER SUPERIOR KNOWLEDGE OF THE
WORK PLACE, FEASIBLE AND ACCEPTABLE METHODS OF ABATEMENT TO
CORRECT THIS HAZARD, AMONG OTHERS ARE:
To follow the manufacturer's recommendation of tightening the "u" bolts
every six
months as indicated in the "CAUTION" section of MICKEY OPERATION AND
SERVICE MANUAL, page 25.
Abatement certification and abatement documentation is required for this
violation.  The
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful.  The abatement
certification sheet is enclosed with the citation(s).
