Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:10/06/09 Location:Elevator Stairwell Condition:Employees were exposed to being struck by an unsecured 56-3/4-inch long H-beam that was placed across a 57-inch span between two I-beams, with hoisting equipment attached, and used to lift an approximate 800-pound elevator control cabinet. Among other methods, one feasible and acceptable abatement method to correct the hazard is to secure all hoisting equipment prior to the lift to prevent the equipment from dislodging and striking employees. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
