Section 5(a)(1) of the Occupational Safety and Health Acto of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from height: On or about January 05, 2010, and at times prior thereto, each employee working on top of a recreational trailer and or other trailers with unprotected sides and edges was not protected from falling by a personal fall arrest system or an appropriate custom fit guardrail system. Employees are exposed to the hazard of falling eight (8) to fourteen (14) feet to concrete and/or ground below. One feasible means of abatement for this hazard, among others, would be to ensure employees performing maintenance/repair work to tops of recreational vehicles and/or other trailers are protected from falls, and that no employee is allowed onto the top of a trailer more than four feet high without adequate protection.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm where employees are exposed to struck-by hazards. On or about January 05, 2010, and at times prior thereto, the employer did not ensure that periodic inspections (one to twelve month intervals) of hoist and hoist components are performed to detect a safety hazard. The hoists are used to move and lift parts and metals onto trailers. Employees working in the shop of the facility are exposed to the hazard of being struck by falling loads in the event of hoist, chain or hook failure. One feasible means of abatement for this hazard, among others, is for the employer to ensure that monthly inspections of hoist and hoist components, with signed and dated reports, are performed to detect any safety hazards.d
