Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm from falls from heights: At the worksite: On or about January 20, 2010, and at times prior thereto, the employer required employees to work in the mast from the monkey board with a Geronimo line ground anchor not installed at a length of 2 times the height of the work platform. Employees were exposed to the hazards associated with falls from heights. Among others, one feasible and acceptable method of abatement would be to comply with manufacturer's installation instructions per the owner's manual for the emergency escape device.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: At the worksite: On or about January 21, 2010, and at times prior thereto, the employer required employees to work on a substructure with missing structural pin keepers such as but not limited to the Southeast corner brace. Employees were exposed to the hazards associated with being caught-in-between and struck by a collapsing substructure. Among others, one feasible and acceptable method of abatement would be to comply with API RP 54 "Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations" for the safe rigging of the rig.
