Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: Blue Ribbon Diner Kitchen: On or about June 29, 2010 employees were working in the kitchen/food preparation area in extreme heat. Employees were exposed to the types of hazard associated with heat, including but not limited to, heat illness, heat stress, heat stroke, and/or dehydration. Temperature measurements were taken using a Wet Bulb Globe Thermometer, and which indicated a temperature of 103.5 degrees fahrenheit in the kitchen.
