Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: Well site; on or about June 22, 2010, employees were operating a pulling unit rig swabbing a new oil/gas well which was starting to produce flammable gas; one employee on the rig was smoking a cigarette down wind from the well head. This exposed all the employees to the hazards of explosion and fire. The American Petroleum Institute Recommended Practice for Occupational Safety for Oil and Gas well Drilling and Servicing operations, RP54,7.1.2 prohibits smoking at or in the vicinity of operations that constitute a fire hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow American Petroleum Institute Recommended Practice RP54, 7.1.3, by permitting smoking only in areas designated for smoking.
