Section 5(a)(1) The employer does not furnish employment and a place of employment which is free from recognized hazards that are causing or likely to cause death or physical harm in that employees are exposed to a struck-by hazard. The employer does not ensure that employees are protected from being struck-by passing vehicular traffic. On or about June 30, 2010, employees working along the edge of Interstate 40 were exposed to being struck-by passing vehicular traffic. Among other methods, recognized and feasible means of abatement to correct this hazard include, but are not limited to: 1. Not assigning work adjacent to highway traffic before erecting the proper lane closure; 2. Full implementation of the applicable elements of the Manual on Uniform Traffic Control Devices; 3. Full implementation of the applicable element of ANSI/ASSE A10.47, Work Zone Safety for Highway Construction, 2009 edition. Pursuant to 29 C.F.R. 1903.19, within ten (10) days, the employer must submit documentation describing the actions it is taking to establish, communicate, and implement written procedures to ensure employee safety when working in proximity to vehicular traffic.r
