Section 5(a)(1) of the Occupational Safety and Health Acto of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to falls from height:
On or about June 30, 2010,  employee was working from the swinging
supports of a 600 ton
crane while configuring the counterweight exposing employee to hazards of
falling 20 feet or
more to the ground below.
Among other methods, feasible and acceptable method of abatement would be
to ensure the
employee and employer reference their crane manufacturer's manual which
states in subject:
Counterweight 9, subpara 9.1 thru 9.4 - Fitting and removing the
counterweights-Risk of
falling - When configuring the counterweight on the counterweight
platform, you can walk
on the front swinging supports.  There is a considerable risk of falling
from
these. The
positioning of the counterweight base plate must be accomplished from
hoist 2.  Walking on
the swinging supports is PROHIBITED.  Safety Regulations 1.4 - The manual
states that
during stacking, the person attaching or detaching the load must be on the
ladder previously
fitted onto the hoist.
