CUMMINS CONSTRUCTION COMPANY, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD SECTION 5(a)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT WHICH WAS CONTAINED IN OSHA INSPECTION 312383623, CITATION NO. 1, ITEM NO. 1 ISSUED ON 08/24/2009. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of electric shock/electrocution while driving and/or operating trucks and trailers with lift beds around energized overhead power lines. On or about August 17, 2009; Cummins Construction Company, Inc. allowed truck drivers to operate trucks and trailers with lift beds in locations containing uninsulated energized overhead power lines. The overhead power lines were not guarded or isolated. Employees of Cummins Construction Company, Inc. were exposed to the hazard of electric shock/electrocution. Methods of abatement include, but are not limited to, developing and implementing effective precautions to prevent employees from contacting overhead power lines by maintaining the Limited Approach Boundary distance, deenergizing and grounding power lines, or guarding the lines at the point of work. Reference; NFPA 70E, 2009 Edition. Limited Approach Boundary distance is 10 feet per table 130.( C).
