Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards created by a material elevator. The elevator operates between the first and the ground floors. On the ground floor there is no means to restrict access to under the elevator when it is on the first floor. During its descent there is the crushing hazard potential. Among other methods, one feasible and acceptable abatement method to correct the hazard is to install an interlocked door or gate on the ground level to prevent entry into the elevator area when it is in the raised position.
