Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm from fall hazards, in that, the platform was not approved in writing from the manufacturer or by a professional engineer: a) On or about September 30, 2009, and at times prior, Effectech, LLC. dba The 13th Door Haunted House, did not ensure that employees were protected from injury, in that, an employee was using a job made platform on a powered industrial truck, that was not approved in writing from the manufacturer or by a professional engineer. Among other methods one feasible and acceptable abatement method to correct this hazardous condition would be to ensure that platform construction is in accordance with manufacturer recommendations (ANSI B56.1-1975). Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
