Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which were free from recognized hazards which were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing and struck-by injuries: a) On or about October 13, 2009 and at times prior, employees were exposed to crushing and struck-by injuries while operating and working near a CAT 416 backhoe with a shop- made lifting device mounted to the front bucket which included modifications to the front bucket including welds, welded-on hooks on top of the bucket and holes through the bucket. This device did not have any rated lifting capacity nor was there any manufacturer approval for modification of the bucket for use with this device. Among other methods, one feasible and acceptable method of abatement would be to only use attachments for the CAT 416 backhoe which are approved or accepted by the manufacturer and in accordance with the manufacturer's specifications and limitations for use of that equipment. Any structural modifications to the equipment, such as welds, for use of attachments must also be approved or accepted by the manufacturer and in accordance with manufacturer's specifications and limitations for use of that piece of equipment. Another method of acceptable abatement would be to use a hoist, crane, or other material handling device with adequate lifting capacity to lift the steel stock from delivery trucks in a safe manner.
