Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
which were causing or likely to cause death or serious physical harm to
employees in that,
employees were exposed to crushing injuries while operating a compactor
without using the
operator restraint system:
a)  On or about February 12, 2010, employees were exposed to crushing
injuries in the event
of a turn-over, while operating a Hamm model 3307 compactor without the
use of the
available operator restraint system (seat belt).
Among other methods, two feasible and acceptable methods to correct this
hazard are to
require and effectively enforce the use of the operator restraint system
(seat belt) provided
for use by the manufacturer and to adhere to SAE J153-Surface Vehicle
Recommended
Practice, Section 4.2-Operator General Precautions, which instructs
operators to: "Wear the
seat belt to maximize the protection of a ROPS (Roll Over Protective
Structure) when the
machine is so equipped."
