Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to fall hazards in excess of 70 feet:
a. On or about February 8 ,2010, and at times prior, the fall protection
being utilized by an
employee, while working from unguarded heights, did not meet the current
criteria of system
components for a personal fall arrest system: 1. The employee used a rock
climbing belt as a
component of a personal fall arrest system. As of January 1, 1998, the use
of "Body Belts"
is limited to use as a positioning device and is no longer approved for
components of a
personal fall arrest system. 2. The employee was utilizing a two lanyard
system, along with
multiple carabiners, which were not approved as part of a fall arrest
system. The lanyards
and carabiners are approved for rock climbing only. Lanyards did not have
adequate strength
or shock absorbing characteristics. 3. The employee was attached to a wire
rope and a roof
mounted pole, neither of which could be verified as capable of having the
proper load rating.
Among other methods the following are feasible and acceptable means of
abating the
hazards: 1. Use harnesses, carabiners, and lanyards, which meet the
requirements of the
American National Standards Institute (ANSI) Z359.1 "Safety Requirements
for Personal Fall
Arrest Systems. 2. Ensure that all carabineers and other hardware being
used meet the
requirements of ANSI Z359.1 and contain the specific marking requirements
called for in the
ANSI standard. 3. Ensure that anchorage points have been certified that
they are capable of
sustaining a 5000 pound minimum load or a minimum 4 to 1 safety factor
whichever is
larger.
