Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards which were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing injuries while operating a forklift without using the operator restraint system: a) On or about February 22, 2010 and at times prior, employees were exposed to crushing injuries in the event of a turn-over, while operating a Case model 586E forklift without the use of the available operator restraint system (seat belt). Among other methods, two feasible and acceptable methods to correct this hazard are to require and effectively enforce the use of the operator restraint system (seat belt) provided for use by the manufacturer and to adhere to ANSI B56.1- 2005 which instructs operators to use the operator protection device or system when provided. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
