Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
which were causing or likely to cause death or serious physical harm to
employees in that,
employees were exposed to struck-by injuries while torch-cutting scrap
metal parts that
contained compressed springs:
a)  On or about April 5, 2010 and at times prior, employees were exposed
to struck-by
injuries from flying debris/pieces while torch-cutting scrap metal parts
that contained
compressed springs enclosed in or attached to these units.  These types of
parts include, but
are not limited to, heavy equipment track units and similar items from
bulldozers,
excavators, cranes and similar equipment.  The employer did not develop
adequate
procedures or provide adequate training for employees performing this type
of activity in
order for them to be able to recognize and control hazards associated with
the task and
perform it in a safe manner.
Among other methods, a feasible and acceptable method to correct this
hazard would be to
train employees on how to recognize what equipment contains compressed
springs, the
hazards of cutting items with compressed springs, and other devices under
pressure
and/or
tension and how to minimize or control such hazards.  Develop a procedure
on how to
systematically assess parts prior to cutting and safely cut units that
contain compressed
springs and similar items under pressure/tension.
