Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the recognized hazard of struck-by and
crushed-by hazards.
(a) On or about April 24, 2010, and at times prior, employees were not
protected from the hazard of being struck-by an unsecured load of pipe
while
pipe was unloaded from a trailer. The employer did not ensure that there
was
an established safe work practice and/or use of equipment in place to
protect
employees from being struck by falling material while loading/unloading
pipe
from trailer.
Among other methods, feasible abatement options include:
1. Provide a means to prevent the pipe from rolling off the trailer, by
using
adequate side
stakes.
2. Utilize mechanical equipment to secure the load prior to off-loading.
3. Develop and implement a work rule preventing standing in front of a
load that is
not secured.
4. Utilize a cradle system to ensure the pipe does not roll during transit
or off-loading instead
of utilizing the 4 x 4 wooden straight boards when loading the pipe onto
the trailer.
IN THE ALTERNATIVE:
29 CFR 1910.176(b):  Material stored in tiers was not stacked, blocked,
interlocked or
limited in height so that it was stable and secure against sliding and
collapse:
(a) On or about April 24, 2010, and at times prior, employees were exposed
to
crushing injury while off-loading pipe from the trailer. The HDPE pipe was
not secured to prevent sliding or rolling after the straps were released.
