Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which was free from recognized
hazards which were
likely to cause death or serious physical harm to employees in that
employees were directed to
use, maintain and operate self-propelled elevating work platforms without
adequate training:
a)  On or about June 25, 2010, and at times prior, Lucas Oil Products,
Inc. dba
Lucas Oil Production Studios HD, failed to instruct employees at the
Thunder
Valley Motocross Racetrack at 701 South Rooney Road in Lakewood, Colorado
to properly use, maintain and operate various models of self-propelled
scissor
lifts.  This includes the SkyJack 7127 rough terrain scissor lift equipped
with a
self-leveling outrigger system from which an employee fell to his death.
1. Employees were not trained to recognize and avoid improper
site positioning.
2. Employees were not trained in the proper use of the outrigger
system including deployment, troubleshooting, and recognition of
and proper response to warning signals.
3. Employees were not trained in the basic understanding of proper
inspection, maintenance and operation.
4. Employees were not trained to recognize and avoid fall hazards
while on the lifts.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is:
Develop a program, to be implemented as part of the company safety
program, which addresses
the training, certification, and company enforcement of proper use,
maintenance and operation
of self-propelled elevating work platforms and to ensure that
manufacturer's guidelines
addressing training and use are followed.

were exposed to fall hazards:
a)  On or about June 25, 2010, and at times prior, Lucas Oil Products
Inc., dba
Lucas Oil Production Studios HD did not ensure that employees at the
Thunder
Valley Motocross Racetrack at 701 South Rooney Road in Lakewood, Colorado
were
protected from fall hazards.
1.  The employer directed utility employees to remove guardrails from ten
scissor lifts at the Thunder Valley Motocross Racetrack at 701 South Rooney
Road in Lakewood, Colorado.   Eight camera operators and technicians were
directed to work from the unguarded scissor lift platforms.  The work that
was
being conducted included the removal of rails, and the set up of the
cameras.
The unguarded scissor lifts were used at heights from 6 to 27 feet.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is:  Follow the manufacturer's specifications to only use the aerial
platform with all
guardrails in place.
