Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees when removing shallow oven baking trays located on upper oven racks above eye level. The baking trays contain grease which can shift and spill during the removal of the tray exposing employees to serious burn hazards: a)On or about May 14, 2010, an employee was burned while removing a shallow oven baking tray from an upper oven rack. The grease on the tray poured off the rack, onto the employee's chest resulting in a serious injury. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure, as per the oven manufacturer's instructions, that pans containing liquid or semi- liquid products are not positioned above the eye level of the operator. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
