Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injuries from defective emergency stops. (a) On or about August 17, 2010, and at times prior, employees were exposed to injury while operating the bagel machine which had a broken emergency stop button which could increase injuries to employees not being able to shut down the machine in a timely manner. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter"). ABATEMENT NOTES: AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO: 1. Replace and/or repair the defective control switch. 2. Follow American National Standards Institute B20.1 2000, "Safety Standard For Conveyors And Related Equipment", Section 5.12(h) which states: Routine inspections and corrective maintenance measures shall be conducted to ensure that all guards and safety features are retained and function properly.
