Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
On or about October 7, 2009, and at times prior thereto, at the job site
located at 208
Rogers Ave., Clarksville, Arkansas, the employer did not ensure the rated
capacity of
the Sky Trak 10054 Telehandler was not exceeded in that the maximum work
load
Including personnel and equipment and the weight of the empty platform had
not been
determined, therefore was not prominently displayed on the platform,
exposing
employees to the hazards of falls from elevation and/or being crushed by
the
equipment
in the event of a tip-over.
Among other methods, three feasible and acceptable abatement methods to
correct this
hazard are to ensure that the employer:  (1) complies with ASME B56.6 -
2002, , Part
III, Section 8.24, Platforms for Elevation Personnel, Section 8.24.1:
Design requirements
for the manufacturer of the platform shall include the following:
paragraph 1 (f) sub-
paragraphs (1) and (2) which states that information containing the
maximum work load
including personnel and equipment and the weight of the empty platform
must be
displayed prominently and (2) complies with ASME B56.6-2002, Part II,
Section 5,
General Practices, Paragraph 5.2.3 which states "If the rough terrain
forklift truck is
equipped with front end attachment(s) or optional forks, the user shall
see that the tuck
is marked to identify the forks or attachment(s), show the approximate
weight of the
truck and fork or attachment combinations, and show the capacity of the
truck with forks
or attachment(s) at maximum elevation with load laterally centered." and
(3) Paragraph
5.3.4 which states "The user shall see that all nameplates and caution and
instruction
markings are in place and legible", (4) Observe and comply with warnings
in Sections
1 and  5.2 and 5.3 regarding unapproved attachments and capacity charts.

On or about October 7, 2009, and at times prior thereto, at the job site
located at 208
Rogers Ave., Clarksville, Arkansas, the working platform was not installed
so that the
it rested against the vertical face of the forks or carriage, exposing
employees
to the
hazards of falls from elevation and/or of being crushed in the event of a
tip-over.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is comply with ASME B56.6- 2002, Section 5.15 Elevating Personnel,
Paragraph
5.15.1(a) which states that "provide a personal platform which complies
with the design
requirements listed in Part III of this standard.".  Part III, Section
8.24 Platforms for
Elevation Personnel requires in paragraph 8.24.1, sub paragraph (g)
states, "means so
that the platform can only be centered laterally on the rough terrain
forklift truck and
retained against the vertical face of the forks, carriage, or lifting
mechanism.

exposed to:
On or about October 7, 2009, and at times prior thereto, at the job site
located at 208
Rogers Ave., Clarksville, Arkansas, the operator of the Sky Trak did not
remain in the
cab of the Sky Trak 10054, while lifting an employee in a shop-made
platform attached
to the forks, exposing the employee to the hazards of falling from
approximately 12 feet
to the level below and/or being crushed by the platform in the event of
equipment failure.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to ensure the operator of the lifting vehicle remains in the cab
during the lift
as required by the Sky Trak 10054 Operation and Safety Manual.

platform, partially
located above a dumpster filled with jagged pieces of lumber, metal
gutters and nails,
exposing the employee to the hazard of puncture wounds and/or impalement.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to ensure that all sharp and/or jagged materials are removed
from beneath the
elevated platform.
