Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
On or about November 05, 2009, and times thereto, an employee was exposed
to the
hazard of falling from a height of approximately 45'.  The employee was
using an
extension ladder from inside the personnel platform in order to reach the
dormer he was
applying vinyl siding to.  The personnel platform had already been raised
approximately
40' to the eave of the building.  The use of the extension ladder on the
platform placed
the employee outside of the protection of the guardrail system built into
the personnel
platform.  The employees' personnel fall arrest system was not employed in
a manner
that would prevent the employee from free falling the allowable six feet
prior to
deceleration.
Two feasible means of abatement would be:
1. A traditional scaffolding system could be erected which would allow
safe access to the
dormer.
2. A lift vehicle with the height capacity to reach the dormer would allow
the employee
to stay within the safety of the personnel platform.
