Labor and Employment Article, Section 5-104(a), Annotated Code of Maryland: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:10/01/09 Location:Construction Yard Equipment:Pettibone Material Lift, Model: #8044, Serial: #3033 Condition:An employee operated the material truck throughout the work site, and was not wearing the seat belt that was provided. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that the employee utilized the existing seat belt while operating the equipment. The proposed penalty for this item has been reduced by 50for effective and efficient abatement during the inspection.
