Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to soil collapse: On November 17, 2009, and times prior thereto, the track of a John Deere excavator was not completely supported on solid footing during trench work operations, exposing an employee to a collapse hazard. Among other methods, one feasible and acceptable means of abatement to this hazard include, but is not limited to, utilizing the blade accessory of the dozer which was available on site to move the soil into the trench without having to place the operator and the equipment on the edge of the trench cut.
