furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm
including being caught in
or crushed by a backhoe loader or the backhoe loader load, to employees in
that employees
were exposed to being caught in or crushed by the backhoe loader or
backhoe loader load:
a)Construction Site 1115 Industrial Parkway in Saraland, AL.:  On or about
September 8, 2009 and prior to, the employer failed to require employees to
wear the seat belt on the Caterpillar 416E Backhoe Loader, product
identification number CAT0416ETSHA02154, while moving material about the
site.
Feasible and acceptable methods of abatement to correct this hazard
include, but are
not limited to the following:
1)Conform to the requirements of ASME/ANSI B56. la-1989 Addenda to ASME
B56.1-1993 Safety Standard that requires the use of seat belts and for
manufacturers to develop a program to retrofit older models.
2)Conform to the requirements of the Caterpillar 416 E Backhoe Loader,
Operators manual WARNING: "A seat belt should be worn at all times
during machine operation to prevent serious injury or death in the event
of an accident or machine overturn.  Failure to wear a seat belt during
machine operation may result in serious injury or death."
