Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Receive injuries, fractures due to fall of 12' high when employees use a metal extensible ladder to climb and down carring boxes and diferents heavy warehouse materials, without safety handrail, to a platform 12' high (aprox). Among other methods, one feasible and acceptable abatement method to correct this hazard is use a ladder with handrail incorpored. Recibir lesiones, fracturas debido a caida de 12' de altura cuando los empleados tenian que subir y bajar una escalera de metal de extension cargando cajas y otros materiales pesados del almacen, sin tener un pasamanos o barandas protectoras, hasta una plataforma a 12' de altura,(aprox.). Entre otros metodos, uno aceptable y posible para corregir este riesgo, es usar una escalera que contenga barandas o pasamanos incorporados.

Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Receive injuries, fractures due to fall from 4'high while using an inadecuate wood ladder, fragil, without handrail or safety guardrail("paleta de madera") to climb and down with heavy warehouse material, boxes from the truck or Van. Among other methods, one feasible and acceptable abatement method to correct this hazard is using a safety stair or ladder with handrail. Recibir lesiones serias, fracturas, debido a caidas de 4'de altura, mientras empleados usaban una escalera inadecuada para subir y bajar del camion o Van, mercancia pesada del almacen, cajas, por esta escalera de madera sin barandas y fragil (paletas de madera). Entre otros metodos, uno aceptable y posible para corregir dicho riesgo es usar unas escaleras seguras, fuertes y con barandas o pasamanos.

Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a. At the workplace of P.R. Retail Stores,/DBA Pitusa Salinas, store #46, Road #1 Km. 1.8, Salinas, P.R. The employer did not have a protocol to handle situations of domestic violence (physical, verbal, and emotional aggression and even murder) at the workplace. Among other methods, one feasible and acceptable method to correct this hazard is to establish and implement a written protocol to manage situations of domestic violence at the workplace as required by Act Number 217 of September 29, 2006. The protocol must include the following minimum requirements: A public policy statement, legal basis and applicability, responsabilities of the personnel, and uniform procedures and measures to be followed in order to handle the cases. a. En el lugar de trabajo en P.R. Retail Stores, Inc. /DBA Pitusa, Salinas, Tienda #46 en Carr.1, Km.1.8, Salinas, P.R. El patrono no tenia un protocolo para manejar situaciones de violencia domestica en el lugar de trabajo. Entre otros metodos, un metodo factible y aceptable para corregir este riesgo es establecer e implementar un protocolo escrito para manejar situaciones de violencia domestica en el lugar de trabajo como es requerido por la ley Numero 217 del 29 de Septiembre de 2006. El protocolo debera incluir los siguientes requisitos minimos: declaracion de politica publica, base legal y aplicabilidad, responsabilidad del personal, y procedimiento y medidas uniformes a seguir en manejos de casos.
