Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:

El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
a.At the establishment, Leafy Green Landscaping, worksite located at
Cerillo Dam
recreational areas. About 6 employees were transported in a Chevrolet van,
year
1996, white color, and plate # CIR-984. This vehicle did not have enough
seats,
two employees were in the cab with the driver and used the seat belts, the
other
4 employees were sitting on white plastic chairs and an armchair in the
back of
the vehicle, these employees did not have seat belt, and the vehicle is not
designed for the transportation of employees in the back or bed of the
truck.
Hazard:  Employees were exposed to automobile accidents due to innapropiate
seats,which could cause serious injuries.
a.En el establecimiento, Leafy Green Landscaping, lugar de trabajo
localizado en
el Embalse Cerrillo area recreacional. Alrededor de 6 empleados eran
transportados en una camioneta marca Chevrolet, ano 1996, color blanco,
tablilla
CIR-984. Dos empleados estaban en la cabina junto con el chofer y
utilizaban los
cinturones de seguridad, los otros 4 empleados estaban sentados en unas
sillas
plasticas blancas y en una butaca en la parte posterior del vehiculo, los
empleados
no tenian cinturon de seguridad, ya que el vehiculo no esta disenado para
el
transporte de empleados en la parte posterior o caja de la camioneta.
Riesgo: Los empleados fueron expuestos a accidentes automovilisticos
debido al
uso de asientos inadecuados, lo que podia ocasionarle lesiones serias.s

a.At the work area, Leafy Green Landscaping. The Employer did not have a
protocol to handle situations of domestic violence at the workplace. Among
others
methods, one feasible and acceptable method to correct this hazard is to
establish
and implement a written protocol to manage situations of domestic violence
at the
workplace as required by act Number 217 of September 29.2006. The protocol
must include the following minimun requirements: A public policy statement,
legal basic and applicability, responsabilities of personnel, and uniform
procedures and measures to be followed in order to handle the cases.
Hazards: Injuries and illnesses related to domestic violence in the
workplace.
a.En area de trabajo, Leafy Green Lanscaping. El Patrono no tenia un
protocolo
para manejar situaciones de violencia domestica en el lugar de trabajo.
Entre
otros metodos, un metodo factible y aceptable para corregir este riesgo es
establecer e implementar un protocolo escrito  para manejar situaciones de
violencia domestica en el lugar de trabajo como es requerido por la ley
Numero
217 del 29 de Septiembre de 2006. El protocolo debera incluir los
siguientes
requisitos minimos: Declaracion de politica publica, base legal y
aplicabilidad,
responsabilidad del personal y procedimiento y medidas uniformes a seguir
en
manejos de casos.
Riesgo: Lesiones y enfermedades relacionadas con violencia domestica en el
area
de trabajo.a
