employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were

El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a: struck by cars
a. At project "Puerto de las Americas", Santiago de los Caballeros Avenue
(PR-14),
employees were making preparations to begin works in a sewer manhole. The
employees
were working on the road without being protected from traffic for any
effective warning
system and reflective clothing. They used three drums as traffic warning
system
to a
distance of eighty-one feets (81') between the first drum and the working
area. The
maximum speed on the avenue was forty miles per hour (40 mph)
Among other methods, feasible and acceptable means to correct these
hazards are to use
a safer alternate method such as: Follow the Manual on Uniform Traffic
Control Devices
for Streets and Highways (MUTCD), 2003 Edition
a. En el proyecto "Puerto de las Americas", Avenida Santiago de los
Caballeros (PR-14),
los empleados estaban haciendo los preparativos para comenzar los trabajos
en la boca
de una alcantarilla. Los empleados estaban trabajando en la carretera sin
ser protegidos
del trafico por algun sistema efectivo de aviso y ropa reflectiva. Ellos
estaban utilizando
tres drones como sistema de aviso a una distancia de ochenta y un pie
(81') desde el
primer drum hasta el area de trabajo. La velocidad maxima de la avenida
era cuarenta
millas por hora (40 MPH). Un metodo viable y aceptable entre otros metodos
para
corregir los riesgos esta el seguir los metodos de seguridad siguiendo:
Manual de
Dispositivos Uniformes de Control de Trafico en calles y carreteras,
Edicion 2003

El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a atmosferas potencialmente peligrosas
a. At project "Puerto de las Americas", on February 4, 2011 an employee
worked in a
sewer manhole without performing any air monitoring or tested prior to
entering to
ensure the atmosphere was safe. The employees were performing painting and
molding
duties. Among other methods, feasible and acceptable means to correct
these hazards are
to use a safer alternate method such as: Follow the Confined Space Survey,
Hazard
Identification, Hazards Evaluation and follow the procedure for Non-Permit
Confined
Spaces (NPCS) or Permit Required Confined Space (PRCS) according to
classification
as outlined in American National Standard ANSI Z117.1-1989 Safety
Requirements for
Confined Spaces, Section 3, Section 4 and Section 5.
a. En el proyecto Puerto de las Americas, el 4 de febrero de 2011,
empleados trabajaron
en una boca de una alcantarilla sin realizar algun monitoreo o prueba de
aire antes de
entrar para asegurarse que la atmosfera era una segura. Los empleados
estaban pintando
y moldeando. Un metodo viable y aceptable entre otros metodos de corregir
esos riesgos
es realizar una investigacion de Espacios Confinados, Identificacion de
Riesgos,
Evaluacion de riesgos y seguir los procedimientos para Espacios Confinados
Sin Permiso
de Entrada o Espacios Confinados con Permiso de Entrada de acuerdo a su
clasificacion
segun se encuentra en el American National Standard ANSI Z117.1-1989 -
Requerimientos de Seguridad para Espacios Confinados, Seccion 3, Seccion 4
y Seccion
5.
