Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a. Elines Construction Corp. exposed their employees to receive injuries due to the operator of a truck (Trademark Ford 750, year 2000, platemate 28120), used to diesel distribution in the construction site, invaded the 20 feet (approximately) safety perimeter where an employee was operating a Nuclear Gauge Machine, to measure the density of the ground. This can produce an emergency situation of nuclear emissions (Cesium-137 and Americium- 241). Among other methods, one feasible and acceptable abatement method to correct this hazard is demark the operation perimeter and training each employee, about the risks. a. Elines Construction Corp, expuso a sus empleados a recibir lesiones serias debido a que el operador del camion (Marca Ford 750, ano 2000, tablilla # 28120), utilizado para la distribucion de diesel en el lugar de construccion, invadio el perimetro de seguridad de 20 pies (aproximadamente) donde, un empleado operaba una maquina de medir la compactacion de terreno,(Nuclear Gauge Machine), que podria emitir radiacion nuclear (Cesium-137 y Americium-241), en caso de accidente o emergencia. Entre otros metodos, un metodo aceptable y posible para corregir este riesgo es demarcar el area de perimetro y adiestrar a cada empleado sobre los riesgos.
