Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
a. Employees exposed to receive injuries at the construction site, in Road
704, Coamo,
due to the employer did not informed officially to the contractor (Elines
Construction
SE), about the hazards conditions or any precautions measures that need to
be taken to
protect employees during the use of a nuclear Gauge Machine (CPN MC-3
PORTAPROBE DENSITY/MOISTURE GAUGE). This equipment, operates by emiting
radiation from two safety-sealed radiactive sorces: Cesium-137 and
Americium-241.
Among other methods, one feasible and aceptable abatement method to
correct this
hazard is to establish an information method, signed by both parts, that
incorporated the
knowlege and how both parts gonna work together during the equipment use.
a. Empleados expuestos a recibir lesiones en el lugar de construccion,
Carr. 704, Coamo,
debido a que el patrono no informo de forma oficial al Contratista (Elines
Construction,
SE), sobre condiciones de riesgo y posibles medidas de precaucion que
deberian tomar
para proteger a los empleados durante el uso de una Maquina de Radiacion
Nuclear
(usada para medir compactacion de terreno), Nombre tecnico: CPN MC-3
PORTAPROBE DENSITY/MOISTURE GAUGE, que opera, emitiendo radiacion desde
2 fuentes radiactivas selladas de forma segura: Cesium-137 y
Americium-241.
Entre otros metodos,un metodo aceptable y posible para corregir este
riesgo, es
establecer un sistema de informacion oficial con la firma de ambos
patronos, donde se
documente el conocimiento y acuerdo entre las partes sobre que medidas se
tomaran
durante la utilizacion del equipo.

a. At the workplace of, Victor E. Rivera Associates, Road # 2 Km. 221.8,
El Tuque,
Ponce.  The employer did not have a protocol to handle situations of
domestic
violence ( physical, verbal, and emotional aggression and even murder) at
the
workplace. Among other methods, one feasible and acceptable method to
correct this
hazard is to establish and implement a written protocol to manage
situations of
domestic violence at the workplace as required by Act Number 217 of
September 29,
2006. The protocol must include the following minimum requirements: A
public
policy statement,legal basis and applicability, responsabilities of the
personnel, and
uniform procedures and measures to be followed in order to handle the
cases. It has
to be evalueted and certified by the Women's Advocate Office.
a. En el lugar de trabajo de Victor E. Rivera Associates, en Carr. #2 Km.
221.8 El
Tuque, Ponce. El patrono no tenia un protocolo para manejar situaciones de
violencia
domestica en el lugar de trabajo. Entre otros metodos, un metodo factible
y aceptable
para corregir este riesgo es, establecer e implementar un protocolo
escrito para
manejar situaciones de violencia domestica en el lugar de trabajo como es
requerido
por la ley Numero 217 del 29 de Septiembre de 2006. El protocolo debera
incluir los
siguientes requisitos minimos: declaracion de politica publica, base legal
y
aplicabilidad, responsabilidad del personal, procedimiento y medidas
uniformes a
seguir en manejos de casos. Este tendra que ser evaluado y certificado por
la Oficina
de la Procuradora de las Mujeres.
