Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a. At the east corner of the construction site. Entering to a confined space is a recognized hazard in the construction industry. Employee was exposed to death, serios burns and serious physical harm. The employers are required to institute feasible means of protecting employees from confined space hazards. The employer did not made the evaluation testing to identify and evaluate any hazardous atmosphere in a confined space, (7 feet large x 4.6 feet wide x 4.6 feet deep), an explotion was produced burning 40 of the employee body. The hazards associated with entry into a confined space, are well recognized, that exposure to these hazards can cause death or serious physical harm. There are a variety of methods available to control hazards confined spaces. On November 15, 2011, a worker was exposed to a hazard(fire) in a confined space (7 feet large x 4.6 feet wide x 4.6 feet deep), due to the lack of a procedure for confined space entry. The employee was assigned to clean and wire (with rope) tubes without a previous characterization of environmental health and safety hazards. There was an explosive atmospheres, that cause explosion and physical damage(burns)to an employee. The American National Standards Institute ANSI Z117.1-1995, and OSHA Standard 29 CFR 1910.146, "Permit-required confined spaces" are examples of references that can be consulted to establish a program. Hazard: Explosion, physical harm, burns. a. En la esquina este del lugar de construccion. Entrar en espacios confinados es un riesgo reconocido en la industria de la construccion. El empleado, fue expuesto a muerte, quemaduras serias y danos f3sicos. Los patronos, estan obligados a instalar los medios posibles para proteger a los empleados de los peligros en espacios confinados. El patrono, no realizo las pruebas de evaluacion para detectar e identificar gases peligrosos en el espacio confinado (7 pies de largo x 4.6 pies de ancho x 4.6 pies de profundidad), donde se produjo una explosion quemando en un 40el cuerpo del empleado. Los peligros asociados con la entrada a un espacio confinado son bien reconocidos, la exposicion a estos peligros, puede causar la muerte o dano f3sico grave. Existe una variedad de metodos disponibles para controlar los peligros en espacios confinados. En noviembre 15 de 2011, un trabajador fue expuesto a riesgos(fuego) en un espacio confinado (7 pies de largo x 4.6 pies de ancho x 4.6 pies de profundidad) debido a la falta de un procedimiento de entrada a espacios confinados. El empleado fue asignado a entrar al espacio confinado para limpiar unos tubos y alambrar (con soga) sin unacaracterizacion(muestreo) previa del medio ambiente sobre los peligros de seguridad y salud. Hubo una exposicion a atmosferas explosivas y/o toxicas, produciendo dano f3sico al empleado. La American National Standards Institute ANSI Z117.1-1995 y norma de OSHA 29 CFR 1910.146, "Permiso de espacios confinados", son ejemplos de referencias que pueden ser consultados para establecer un programa. Riesgo: Explocion, riesgo f3sico, quemaduras.

At the workplace of EST Electrical Contractors & Engineering Corp at Las Americas Ave. in the construction of a Walgreens on Ponce, PR. The employer do not provide trainning to all employees to handle situations of domestic violence(physical, verbal, emotional aggression and even murder) at the workplace. Among other methods, one feasible and acceptable method to correct this hazard is to establish and implement an anual trainning to manage situations of domestic violence at the workplace as required by Act Number 217 of September 29, 2006. The protocol must include the following minimum requirements: A public policy statement,legal basis and applicability, responsabilities of the personnel, and uniform procedures and measures to be followed in order to handle the cases. a. En el lugar de trabajo de EST Elecrical Contractors & Enginnering Corp, en la Avenida Las Americas, en la construccion de un Walgreens, en Ponce PR. El patrono no realizo un adiestramiento a todos los empleados para manejar situaciones de violencia domestica en el lugar de trabajo. Entre otros metodos, un metodo factible y aceptable para corregir este riesgo es establecer e implementar un adiestramiento anual para manejar situaciones de violencia domestica en el lugar de trabajo, como es requerido por la ley Numero 217 del 29 de Septiembre de 2006. El protocolo debera incluir los siguientes requ3sitos m3nimos: declaracion de pol3tica publica, base legal, apicabilidad, responsabilidad del personal, procedimientos y medidas uniformes a seguir en el manejo de casos.
