Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while climbing the rails of the scissor lift basket: a) 126 Water Street, Newton, NJ. Employees were observed climbing the rails of a scissor lift basket to access the joist/work surface, thereby exposing the employees to a fall hazard of 17 feet to the ground. Violation observed on or about 10/20/2009. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1 Level the floor of the scissor lift basket with the top of the joist and then open the door of the basket and walk out onto the joists with the proper fall protection.
