Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazard:
a) 14th Street Garden Center, Jersey City, NJ.
An employee was observed working from a makeshift platform on the forks of
a forklift without
any means of fall protection, thereby exposing the employee to a 12 feet
fall hazard.
Violation observed on or about 10/29/2009.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is:
1. Use a manlift cage, with a personal fall arrest system, to ensure the
protection of employees
from falling when being lifted up to change out the light bulbs.
