Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that the
employees were exposed to being struck by vehicle(s) operating in the area
of the waste
collector:
a) Brown's Trash Removal, Inc. on or about January 20, 2010, at the site
located on CR 775
North of Twp Rd 2206 Perrysville, OH: The employer did not require
employees collecting
solid waste alongside roadways to wear high visibility apparel. An
employee performing
residential curbside pick-up without a high visibility vest was struck by
an oncoming vehicle,
fatally injuring the worker.
One feasible and acceptable method to correct this hazard is to ensure
employees wear high
visibility garments as prescribed in appendix B and C of ANSI/ISEA
107-2004
High
Visibility Apparel. ANSI Z245.1-2008 Section 6.1.7.8, in that the employer
requires high
visibility apparel as appropriate to the tasks assigned and conditions
that employees will
experience as prescribed in appendix B and C of ANSI/ISEA 107-2004 High
Visibility
Apparel.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the
purchase or repair of the equipment, photographic or video evidence, or
written records.
