29 CFR 1910.119(e)(3)(i):  The process hazard analysis did not address the
hazards of the
process:
a)  United Initiators, Inc. - Elyria, Ohio:  On or about August 11, 2010,
the employer failed to
assure that the most recent process hazard analysis (PHA) conducted
related to the skimmer unit
included an evaluation for the potential of thermal effects on organic
peroxides creating a fire
hazard, and an evaluation of the water spray cooling system and early
detection systems, such
as temperature indicators and alarms, to prevent a potential runaway
decomposition reaction.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence, or written
records.

that the process
hazard analysis team's recommendations are resolved in a timely manner and
that the resolution
is documented:
a)  United Initiators, Inc. - Elyria, Ohio:  On or about August 11, 2010
the employer failed to
assure that a system was established in which recommendations made during
the original process
hazard analysis (PHA) for unit B-31 were resolved, and this resolution
documented.  Multiple
individual instances existed within the PHA that did not have documented
resolution, including
recommended changes to process safety information, the implementation of a
car seal policy for
manual control valves, changes to relief devices, and the software
programming related to
system interlocks and alarms.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,

assure that the pre-start up safety review (PSSR) conducted for unit B-31
prior to its
commissioning, included a review to confirm that recommendations made
during the initial
process hazard analysis (PHA) were resolved, and that those resolutions
were documented.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your

revalidated or
updated at least every five years.  As of August 11, 2010, the most recent
PHA conducted on
B-31 was completed in January 2005.
b)  United Initiators, Inc. - Elyria, Ohio:  On or about August 11, 2010,
the employer failed to
assure that the process hazard analysis (PHA) conducted for unit B-14 was
revalidated or
updated at least every five years.  As of August 11, 2010, the most recent
PHA conducted on
B-14 was completed in February 2002.
c)  United Initiators, Inc. - Elyria, Ohio:  On or about August 11, 2010,
the employer failed to
assure that the process hazard analysis (PHA) conducted for unit B-11 was
revalidated or
updated at least every five years.  As of August 11, 2010, the most recent
PHA conducted on
B-11 was completed in May 1999.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included

corrected and the corrective
action documented.  The 2007 compliance audit found that the employer had
not revalidated
process hazard analyses (PHAs) on the required five year basis, and as of
August 2010, three
instances existed where process units had still not had their PHAs
revalidated.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
