Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that a workplace
hoist was not in good repair, as the hoist hook was not equipped with a
throat latch:
a) Whitaker Finishing LLC, Northwood, Ohio:  On or about September 29,
2010,
the employer did not ensure that the hook on the overhead Budgit (Model
BEH132) underhung hoist, located in the plating area, was equipped with a
throat
latch, exposing employees to struck-by and crushing hazards should the
dumper
being lifted roll out of the hook.
Among other methods, one feasible and acceptable method to correct this
hazard is to comply
with the requirements of ASME B30.16-2007 "Overhead Hoists (Underhung)",
Section 16-1.2.9
"Hooks".
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
