Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees, in that the
fall protection systems and anchorage points used in the wash bay were not
capable of
providing adequate fall protection:
a) Store & Haul, Inc., located on 1165 Grill Road in Van Wert, OH:  On or
about January
20, 2011, the employer failed to ensure that personal fall protection
systems provided in the
wash bay had the proper components, connections and anchorage points to
provide the fall
arrest necessary to protect employees washing tank haulers approximately
nine feet above
concrete flooring, in that, the purlins used as anchorage points would not
provide the
necessary strength to support the static load. In addition, the wire ropes
along with
improperly attached wire clips were not acceptable intermediary forms of
connection for use
with the self retracting lanyard system.
ABATEMENT NOTE: Among other methods, one feasible and acceptable method to
correct
this hazard is to comply with the American National Standard Institute
(ANSI) Z359.1 -2007
Safety Requirements for Personal Fall Arrest Systems, Subsystems, and
Components.
Additionally, following manufacturer's recommendations is also a means of
correcting this
hazard.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the
purchase or repair of the equipment, photographic or video evidence, or
written records.
