General-duty citation text

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to wood dust explosions, deflagrations, or other fire hazards
because methods
were not utilized to ensure proper collection of and prevent ignition of
combustible wood dust
during generation and collection operations.
a.Peters Family Enterprises, Inc. located in Lima, Ohio:  On or about
February 17, 2011,
the dust collection system located on the west side of the facility
contained the following
hazards:
1.Blower fans were located on the upstream side of the cyclones;
2.Cyclones were not provided with deflagration isolation devices;
3.Ductwork leading to the cyclones was not provided with deflagration
isolation
devices;
4.There were no devices located between the cyclone and the saw dust
collection
bins to prevent explosion propagation between the pieces of equipment.
Abatement Note: Among other methods, one feasible and acceptable abatement
method to
correct this hazard is to comply with National Fire Protection Association
(NFPA) 664-2007
Prevention of Fires and Explosions in Wood Processing and Woodworking
Facilities", including,
but not limited to: a) Install a deflagration detection and suppression
system
in accordance with
Chapter 8 of NFPA 664. b) Locate fans on the clean air side of the
cyclones in accordance with
Chapter 8 of NFPA 664. c) Install a choke point between the cyclones and
the saw dust storage
bins in accordance with Chapter 8 of NFPA 664.
Step 1: Within 30 days submit to the Area Director a written, detailed
plan of abatement
outlining a schedule for the implementation of engineering and/or
administrative measures to
control employee exposure to hazardous substances as referenced in this
citation.  This plan shall
include, at a minimum, target dates for the following actions which must
be consistent with the
abatement dates required by this citation:
1. Evaluation of engineering /administrative controls options;
2. Selection of optimum control methods and completion of design;
3. Procurement, installation and operation of selected control measures;
and
Step 2: Abatement shall have been completed by the implementation of
feasible engineering
controls upon verification of their effectiveness in achieving compliance.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition,documentation demonstrating that abatement is complete must be
included with your
certification.  This documentation may include, but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence, or written
records.
