Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that the 3-ton
Yale hoist (Serial # W481738) was outfitted with a hook without a safety
latch, exposing
employees to struck-by hazards in that the load and/or the lifting device
could be dislodged from
the hook.
a.Quality Machining & Manufacturing, Inc., located at 14168 State Route
18, Sherwood,
OH: On or about February 22, 2011, the employer did not ensure that the
3-ton Yale
hoist (Serial # W481738) was outfitted with a hook equipped with a safety
latch,
exposing employees to struck-by hazards in that the load and/or the
lifting device could
be dislodged from the hook.
Among other methods, one feasible and acceptable method to correct this
hazard is to comply
with the requirements of American Society of Mechanical Engineers (ASME)
B30.16-2007
"Overhead Hoists (Underhung)", Section 16-1.2.9 "Hooks"
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence, or written
records.

hoist's pendant control buttons were not  properly labeled, as well as
unused button openings
were not properly covered. If an employee accidentally presses a wrong
button on the pendant
control due to the lack of proper labeling and moves a steel bundle in an
unintended direction,
it exposes employees to struck-by and crushing hazards.
aQuality Machining & Manufacturing, Inc., located at 14168 State Route 18,
Sherwood,
OH: On or about February 22, 2011, the employer failed to ensure that the
pendant
control, used with the 3-ton Yale hoist (Serial # W481738), was properly
maintained.
The employer did not ensure that all of the pendant's buttons were
properly labeled, as
well as unused button openings were properly covered.
Among other methods, one feasible and acceptable method to correct this
hazard is to ensure the
pendant control buttons are properly labeled as to their functions
according to American Society
of Mechanical Engineers (ASME) B30.11-1998 "Monorails and Underhung
Cranes."
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
